The second Court of Cassation of General jurisdiction refused to satisfy the Plaintiffs’ complaints and upheld the appeal ruling unchanged. The Defendants —clients of MCBA “Bureau of Lawyers “De jure” — carried out the conversion of the apartment to a non-residential premises. Residents of the house appealed to the court and filed a claim for the invalidation of the minutes of the meeting of owners of premises, on the basis of which the transfer of the premises to non-residential was carried out. The court of the first instance satisfied their demands, but the Moscow City Court overturned the decision on procedural grounds, reviewed the case under the rules of the first instance and refused to satisfy the claim.
The interests of the Defendants were defended by Nikita Filippov, Head of MCBA “Bureau of Lawyers “De jure”, and the interests of third parties on the Defendants’ side were represented by lawyers of “De jure” Tatyana Bogomolova and Alexey Strulev.
Lyubertsky District Court of the Moscow Region partially satisfied the requirements of the Bank by recovering from the Defendant debt in the amount of about 300 thousand rubles debt under the overdraft agreement . The interests of the Bank were represented by lawyer of MCBA “Bureau of Lawyers “De jure” Konstantin Glushkov.
