A company that leases a land plot from the state has appealed to MCBA “Bureau of Lawyers “De Jure” with a request to help reduce the amount of rental payments calculated on the basis of the cadastral value of the land plot. The result of the work of lawyers of “De Jure” was the decision of the Moscow City Court, which established the true market value of the plot, reducing it by more than 20 million rubles (from 135 million to 114 million).

Lawyers of “De jure” won the case for recovering debt, interest and penalties from an unscrupulous borrower. Initially, Nikulinsky District Court of Moscow refused to satisfy the claims of our Principal. In the appeal the lawyers indicated that the judicial handwriting examination was conducted with significant violations, the tax declaration confirming the possibility of issuing such a large loan amount was lost by the court, and therefore was not taken into account. In the Moscow City Court, the Bureau’s lawyers were able to rich that handwriting re-examination to be held and the documents which had been lost by the court of the first instance to be attached to the case. Repeated handwriting examination could not unambiguously establish whether the borrower had signed loan agreements disputed by him. However, lawyers of “De jure” presented enough indirect evidence of the reality of the loan relationship. As a result, the decision of the court of the first instance was canceled, and a new judicial act was adopted to recover about 8.7 million US dollars from the borrower in favor of our Principal. The interests of the Plaintiff were represented by Nikita Filippov, Head of MCBA “Bureau of Lawyers “De Jure”, and Yakov Bulut, lawyer of the Bureau.
