July 14. MAIN RESULTS OF THE DAY

Simonovsky district court of Moscow ruled in favor of the client of MCBA “Bureau of Lawyers “De Jure”. Our Principal requested to fix the removal of encumbrances in the form of mortgages on non-residential premise, as in the bankruptcy case of the guarantor and the mortgagor under the loan agreement, the creditors ‘ claims were fully repaid, and the case itself was terminated. The Respondent objected, referring to the fact that debt on penalties, fines and interest were not repaid. In court, lawyers of “De jure” managed to prove that during the bankruptcy procedure, penalties, fines and other penalties are not accrued. Since the obligation itself is fulfilled in full, the court issued a decision to recognize the encumbrance as absent. The Moscow arbitration court rejected the objections of the Federal Tax Service of Russia № 9 on major taxpayers. The Moscow arbitration court according to the requirements of the bankruptcy Trustee of the Bank – client of “De jure” excluded from the register requirements of two creditors for a total amount of 7.7 million rubles.
