July 23. MAIN RESULTS OF THE DAY

The second cassation court left unchanged the decisions of lower courts, which refused to satisfy the claim against the Principal of MCBA “Bureau of Lawyers “De Jure” – an Educational Institution for the collection of funds.  The interests of the Educational Institution were defended by Rashid Gitinov, lawyer of MCBA “Bureau of Lawyers “De Jure”.

The Kolomna City Court of the Moscow Region satisfied the claims of an individual – client of MCBA “Bureau of Lawyers “De Jure” on the recognition of the results of the auction of the client’s property (disputed apartment) as illegal, invalidation of the contract of sale of real estate concluded with the winner of the auction, recognition of the client’s ownership of the disputed property. The client learned about the sale of his apartment at a public auction in the course of the enforcement proceedings initiated on the basis of the absentee decision of the Domodedovo City Court, only from the new owner of the apartment (the winner of the auction). During the trial, lawyers of “De Jure” managed to prove that the transfer of the Client’s property to a public auction was illegal due to the violation of the requirements of the Federal Law “On Enforcement Proceedings” by the bailiff.
