The Arbitration Court of the Moscow Region granted the application of the bankruptcy trustee of the Bank, whose interests are represented by MCBA “Bureau of Lawyers “De jure”, to declare illegal the refusal of the bailiff to foreclose on the debtor’s funds held in the account of the same Bank, with their subsequent transfer back to the bankruptcy estate of the Bank in the framework of enforcement proceedings on the request for repayment of the loan. The bailiff believed that this violates the order of satisfaction of creditors ‘ claims, and the revocation of the Bank’s license prevents the issuance of a resolution on foreclosure on the debtor’s funds. But the court found the Bureau’s arguments convincing. The total amount of the expected receipt is 300 million rubles. The interests of the bankruptcy trustee were represented by Alexander Uchaykin, senior lawyer of MCBA “Bureau of Lawyers “De jure”.
