August 3 Main results of the day

The Ninth Arbitration Court of Appeal on the complaint of MCBA “Bureau of Lawyers “De jure” canceled the earlier decision of the Moscow Arbitration Court on the exclusion of the debtor of real estate from the bankruptcy estate. The court made a decision based on the fact that the real estate is the only housing of the debtor. In the appeal instance, MCBA “Bureau of Lawyers “De jure” managed to prove that the debtor had abused his rights, trying to give the luxury housing executive immunity. The property was returned to the bankruptcy estate for further sale and purchase of adequate housing to the debtor. The remaining funds will be used to repay the debt to the Bankruptcy Creditor. The interests of the Bankruptcy Creditor in the bankruptcy case were represented by Sergey Bibikov, senior lawyer of MCBA “Bureau of Lawyers “De jure”.
