The Arbitration Court of the Stavropol Territory recognized the claims of the Principal of MCBA “Bureau of Lawyers “De jure” to include in the register of claims of the debtor’s creditors the amount of the debt in the amount of 27 million rubles as justified and introduced a monitoring procedure against the debtor. The interests of the Principal were represented by Taisiya Radchenko, senior lawyer of the Bureau.
As part of the bankruptcy procedure, the Ninth Arbitration Court of Appeal left the judicial act of the court of first instance unchanged, and the debtor’s appeal was not satisfied. Earlier, the court of first instance, at the request of the Creditor, whose interests are represented by MCBA “Bureau of Lawyers “De jure”, invalidated the contract of donation of a share in an apartment concluded between the Debtor and his mother. The interests of the Creditor were defended by Alexandra Reznichenko, senior lawyer of the Bureau.
The Moscow City Court satisfied the requirements of an Individual Entrepreneur, whose interests were represented by MCBA “Bureau of Lawyers “De jure”, and revised the size of the cadastral value of non–residential premises, reducing it by almost half – from 22,093,320 rubles to 11,781,095 rubles. Challenging the cadastral value, the Applicant submitted an expert report to the court, at the request of the DGI of Moscow (the Defendant) a forensic examination was carried out. The Defendant did not agree with the expert’s conclusions and requested a re-examination. Taking into account the positions of the parties, the court dismissed the request for a re-examination and satisfied the applicant’s claims in full. The results of the consideration of the court dispute will allow the Individual Entrepreneur to significantly reduce tax costs. The protection of the interests of the Individual Entrepreneur was carried out by Evgenia Kachanovskaya, lawyer of MCBA “Bureau of Lawyers “De jure”.
