As part of the enforcement proceedings, which was accompanied by MCBA “Bureau of Lawyers “De jure”, more than a thousand cars of PJSC MOEK were arrested for a debt in the amount of 145 thousand rubles to the Principal of the Bureau. This news even made it onto the pages of Rossiyskaya Gazeta. Yakov Bulut, head of the practice of resolving economic disputes of MCBA “Bureau of Lawyers “De jure”, told the newspaper that since the energy supplying organization refused to voluntarily pay the debt, the Bureau applied to the bailiffs service with an application to initiate enforcement proceedings and a petition to search for and arrest the energy supplying organization property. Considering that the debt was not paid even after the initiation of enforcement proceedings, the bailiff-executor granted the Principal’s petition, received information about the property of the energy supplying organization and arrested it. The uniqueness of the case is that all the equipment of PJSC MOEK was arrested. According to the norms, the amount of the arrested property in value should be commensurate with the amount of debt. However, in this case, although the debtor had numerous equipment and vehicles on its balance sheet, the bailiff did not have information about their market value. Therefore, the arrest was imposed on the entire vehicle fleet. The arrest warrant itself is written on 169 pages. The interests of the Principal were represented by Yakov Bulut, lawyer, head of the practice of resolving economic disputes of MCBA “Bureau of Lawyers “De jure”.
