The Arbitration Court of the West Siberian District satisfied the complaint of the Client of MCBA “Bureau of Lawyers “De jure” and canceled the earlier decisions on the refusal to the Client to satisfy the stated requirements. Within the framework of this dispute, the issue of invalidity of the results of the procurement in the form of a request for quotations in electronic form was considered. In the court of cassation instance, it was possible to prove that the procurement conditions were violated during the tender procedure, since the goods offered by the winner of the procurement did not have equivalent characteristics. This was the basis for canceling the earlier decisions of the courts, the dispute was returned to the court of first instance for a new consideration. The interests of the Client were represented by Alexander Chernyshev, lawyer of MCBA “Bureau of Lawyers “De jure”.

The Arbitration Court of the Kursk Region satisfied the application of the Bankruptcy Trustee for the issuance of a writ of execution in the amount of 13.8 million rubles in the framework of the bankruptcy case, the proceedings for which were terminated. The court proved the existence of grounds for issuing a writ of execution, as well as the possibility of applying to disputable legal relations on analogy of the law the provisions of point 2 of paragraph 5 of Article 213.28 of the Bankruptcy Law. The interests of the Bankruptcy Trustee were represented by Vladimir Leonov, senior lawyer of MCBA “Bureau of Lawyers “De jure”.

The Moscow Arbitration Court fully satisfied the requirements of the Principal of MCBA “Bureau of Lawyers “De jure” and decided to settle the disagreements that arose between the Client and the Moscow City Property Department when concluding a contract for the sale of non-residential premises. The redemption market value of the building was reduced by 25 million rubles, the size of penalties for violation of obligations under the contract was reduced by 2 times, the period of violation of the obligation was increased by 2 times, many other illegal provisions of the contract were excluded. Also, legal costs in the amount of 96 thousand rubles were collected from the Department. The interests of the Principal were represented by Semyon Garayan, senior lawyer of the practice of resolving disputes with state bodies, disputes in the field of intellectual property and corporate rights.
