The Moscow Arbitration Court dismissed the application of the Bank’s shareholders about their intention to fulfill the obligations of the credit institution. The lawyers of MCBA “Bureau of Lawyers “De jure” managed to prove to the court that the applicant’s actions were seen as an abuse of the right, and references to Article 189.93 of the Bankruptcy Law are not lawful, since the application of this article is due solely to the insufficiency of the funds of the credit institution. The interests of the bankruptcy trustee of the Bank were represented by Andrey Khokhlov, senior lawyer of the Bankruptcy Dispute Resolution Practice of MCBA “Bureau of Lawyers “De jure”.
