The Ninth Arbitration Court of Appeal, having considered the appeal of the procedural opponent of the Bureau of Lawyers “De jure”, left the judicial act unchanged, terminating the proceedings on the appeal. The Court of Appeal agreed with the position of the Bureau’s lawyer that the loss of the status of a creditor, including after the appeal is accepted for consideration by the court, terminates special rights that allow the creditor to challenge judicial acts issued against other creditors. The interests of the Principal were represented by Valentina Petrova, lawyer, First Deputy Head of the Bureau of Lawyers “De jure”.
The Moscow Arbitration Court ruled on the claim of the Department of City Property of Moscow, brought against the Principal of the Bureau of Lawyers “De jure”, on the collection of debt in the total amount of 202 million rubles under a contract for the sale of real estate. Bureau employees developed a defense strategy that aimed not only to reduce the amount of claims as much as possible, but also to retain ownership of the real estate object by the Principal of the Bureau. The court agreed with the legal qualification of the consequences of a breach of obligation by the Principal and partially satisfied the claim, out of the declared 202 million rubles, it recovered only 8 million rubles from the Principal of the Bureau, while the ownership of real estate was completely removed from the threat. The interests of the Principal were represented by Konstantin Tkachenko, Head of the practice of legal support of entrepreneurship at the Bureau of Lawyers “De jure”.
