The Moscow Regional Court, having considered the Appeal of the Principal, canceled the decision of the court of first instance and dismissed the claim of procedural opponents against the Principal to determine the procedure for communication and remove obstacles to communication with the incapacitated. In the court of appeal, the lawyers of the Bureau managed to prove a clear violation of the norms of substantive and procedural law committed by the court of first instance when considering the dispute. The correctly chosen strategy allowed the Principal to prove that the stated claim is not aimed at restoring the violated rights of the incapacitated, but may harm him. Moreover, the Plaintiffs chose an improper method of protecting the right. The interests of the Principal were represented by Nikita Filippov, Head of MCBA “Bureau of Lawyer “De jure”, and Tatyana Bogomolova, lawyer of the Bureau.
