The Moscow City Arbitration Court satisfied in full the claims of the Principal of the Bureau of Lawyers “De jure” to the Department of City Property of Moscow on the settlement of disagreements under the contract of sale of non-residential premises. During the consideration of the dispute, the lawyers of the Bureau managed to convince the court that the market value of real estate was excessively overpriced; as a result, the price for the municipal premises was reduced by more than 2 million rubles by the court. The interests of the Principal were represented by Ilsur Zakirov, a trainee lawyer of the Bureau of Lawyers “De jure”.
The Second Cassation Court of General Jurisdiction upheld the judicial acts of the lower courts in a complex dispute on the recognition of the former spouse’s ownership of real estate acquired during the marriage. The consideration of the case was complicated by the fact that the former spouse, being in bankruptcy, asked the court, like his creditors, to recognize the disputed property as the common property of the spouses. As a result, the procedural opponents were denied satisfaction of the cassation appeal, and the disputed property was recognized as the property of the Bureau’s Client. The Nikulinsky District Court of Moscow satisfied the administrative claim of the Principal of the Bureau against an official of the Troparevo-Nikulinsky Bailiffs Department, the Head of the Main Directorate of the Federal Bailiff Service in Moscow, on the recognition of illegal actions (inaction) of officials, expressed in the unlawful termination and non-resumption of enforcement proceedings against the debtor of the Principal. During the trial, the court found that the bailiff of the Troparevo-Nikulinsky Bailiffs Department did not take the necessary steps to establish the debtor’s property, did not evaluate and sell it. The inaction of the Head of the Main Directorate of the Federal Bailiff Service, expressed in the improper organization of the work of the territorial department, failure to respond to the Principal’s appeals, was also recognized as illegal. As a result of the proceedings, the court ordered, by its decision, officials to resume enforcement proceedings against the debtor and take appropriate measures to sell his property.
