The Arbitration Court of the Moscow District upheld the judicial acts of lower instances, and refused to satisfy the cassation appeal of the bankruptcy trustee on the establishment of excessive incentive remuneration in the amount of 45 million rubles. Lawyers of the Bureau provided evidence to substantiate their position that the fact that the managers filed an application for bringing to subsidiary liability is not enough to pay remuneration. A significant causal link was also proved between the repayment of creditors’ claims and the emergence of such a financial opportunity for the debtor participant. The interests of the Client, a participant of the debtor, were represented by Ivan Bychkov, lawyer of the Bureau of Lawyers “De jure”.
