The Moscow Arbitration Court included the Principal’s claim in the amount exceeding 400 thousand rubles in the register of claims of the debtor’s creditors. The interests of the Principal were represented by Daria Ivanova, senior lawyer of the Bureau of Lawyers “De jure”.
The Moscow City Court upheld the decision of the Khoroshevsky District Court of Moscow, which refused to satisfy the claims of procedural opponents of the Bureau of Lawyers “De jure” to recognize the contract on the subsequent mortgage as not concluded and to cancel the mortgage record. The lawyers of the Bureau of Lawyers “De jure” managed to convince the court that the Plaintiff was abusing his procedural rights and was trying to drag out the procedure for the sale of property within the framework of enforcement proceedings. The Arbitration Court of the Moscow District agreed with the legal position of the Bureau of Lawyers “De jure” and refused the procedural opponents to satisfy their cassation appeal against the ruling of the court of appeal to suspend the proceedings. The proceedings in the case were suspended due to the appointment, at the request of the Bureau, of a forensic handwriting examination, one of the issues on which was the verification of the signing of the documents disputed by the opponent. The establishment of this circumstance will allow the Bureau of Lawyers “De jure” to refute the results of the examination conducted by the court of first instance and recover the debt in the amount of over 5 million rubles in favor of the Principal.
