The Arbitration Court of the Moscow District agreed with the legal position of the Bureau of Lawyers “De jure” and left the decision of the court of appeal unchanged. Earlier, within the framework of this dispute, the Bureau of Lawyers “De jure” managed to cancel the negative decision of the Moscow Arbitration Court and, already in the court of appeal, conduct a second handwriting examination, the results of which proved the fact that the parties had signed the contract. In turn, this made it possible to prove the fact of the existence of losses caused to our Principal, as well as grounds for the Defendants to collect payment for the refusal of the goods provided by the Principal. In an attempt to protest the conclusion of the examination, the Defendant stated that the court of appeal did not attach a review for re-examination to the case materials. The Court of cassation instance considered this argument of the Defendant essential, since in case of confirmation of this fact it would be the basis for the cancellation of the decision taken by the appellate instance. In this regard, the court announced a break for a deeper study of this issue. Taking advantage of the break, the lawyers of the Bureau of Lawyers “De jure” used a non-standard move and promptly prepared written explanations about the groundlessness of the Defendant’s arguments and an attempt to mislead the court. The return of the review by the court of appeal was due to the fact that this document was not attached by the Defendant to the case materials as independent evidence, but was an appendix to the petitions, the satisfaction of which was denied to the Defendant. The stated arguments of the Bureau of Lawyers “De jure” turned out to be the decisive argument and tipped the scales of Themis in favor of our Principal. The total amount of funds recovered in favor of the Principal amounted to more than 70 million rubles. The interests of the Principal were represented by Nikita Filippov, Head of the Bureau of Lawyers “De jure”, and Ilsur Zakirov, senior lawyer of the Bureau.
