The Moscow City Arbitration Court has preserved over 6 thousand square meters of the building owned by our Principal. Denying the Moscow City Government and the Department of State Property of Moscow to satisfy the claim brought against the Principal, and rejecting the application for the appointment of a repeated construction and technical expertise, the court agreed with the arguments of the Bureau’s lawyers about the availability of all necessary permits for the construction of a capital construction facility and the illegality of the Plaintiffs’ arguments about the Defendant’s failure to submit a construction permit, since the legislation did not provide for the issuance of a construction permit during the construction of the disputed facility, and the composition of the initial permit documentation giving the right to build an object included two documents: the order of the prefect on permitting the design / construction (reconstruction, restoration, expansion) of buildings and the urban planning conclusion. The interests of the Principal were represented by Rashid Gitinov, Head of the practice of resolving disputes with state bodies.
The Volokolamsk City Court of the Moscow region ruled in favor of our Principal on foreclosure on the debtor’s real estate worth 3 million 200 thousand rubles. The court found that the debtor evades the fulfillment of its obligations to return the funds. Thanks to the active actions of lawyers in the framework of enforcement proceedings initiated against the debtor, it was revealed that the debtor owns liquid real estate, at the expense of which the debt to the Principal can be repaid. Judicially, lawyers levied execution on the debtor’s unsecured property in the Volokolamsky district of the Moscow region. Based on the results of the appraisal examination, it was determined that the residential building in the gardening non-profit partnership is suitable for permanent residence and is in good condition. At the moment, lawyers are expected to enter into force of a judicial act, after which they will take measures to sell real estate in the framework of enforcement proceedings and transfer funds to the Principal.
