Four million rubles were recovered in favor of the Principal. By the decision of the Arbitration Court of the Moscow District, the judicial acts of lower instances on debt collection from the Principal’s counterparty were left unchanged; the opponent’s complaint was not satisfied. The complexity of this process was in the Defendant’s attempt to re-evaluate the evidence available in the case materials, which contradicts the procedure for considering the dispute in the court of cassation instance and goes beyond its powers. The lawyers of the Bureau of Lawyers “De jure” managed to convince three experienced judges of the cassation instance of the legitimacy and validity of the Principal’s arguments and the complete absence of grounds for satisfying the demands of opponents. In all previous instances, victory was also achieved in this case. The interests of the Principal were represented by Dan Khorolets, lawyer of the practice of resolving economic disputes of the Bureau of Lawyers “De jure”.
The Principal developer won a fundamental victory in a dispute with the Territory Development Fund. The Arbitration Court of the Rostov Region refused the Territorial Development Fund on the application for declaring the Principal insolvent (bankrupt) and introducing bankruptcy proceedings. The application of the Fund itself was considered in court for more than a year, during this period the developer managed to successfully complete the construction of a residential apartment building, which was delayed through no fault of his own. Thanks to the competent and well-coordinated actions of attorneys and lawyers of the Bureau, in the end it was possible to convince the court that there were no signs of insolvency of the Principal, and also to prove the absence of reasons for introducing the bankruptcy procedure of the developer on special grounds.
