February 15 Main results of the day

The Arbitration Court of the Moscow District, in the framework of the bankruptcy case of the debtor – a limited liability company, canceled the decision of the appellate instance on bringing the Principal of the Bureau of Lawyers “De jure” to subsidiary liability for a total amount of 3.5 million rubles. Lawyers of the Bureau managed to convince the court of cassation instance of the correctness of the conclusions of the court of first instance, which initially refused to satisfy the claim. They also managed to prove that the bankruptcy trustee incorrectly determined the moment of the Debtor’s insolvency. The Principal, being the general director of the debtor during the disputed period, faithfully carried out his duties, implementing a plan to bring the Company out of crisis. The interests of the Principal in court were represented by Viktor Pokormyak, lawyer of the Bureau of Lawyers “De jure”, and Alexandra Reznichenko, the trainee lawyer.
