The Savelovsky District Court of Moscow issued an additional decision in favor of our Principal on the collection of interest for the use of two credit lines and a contractual penalty for the period from 2021 to the date of actual repayment of the debt. Thanks to the successful work of the lawyers of the Bureau of Lawyers “De jure”, the Principal recovered additional 83 million rubles of interest and penalties on loans from the group of debtors, and also restored his right to recover funds for the future period. During the trial, which lasted two days, the debtors failed to convince the court that the Principal had previously been denied the collection of funds for the future period, and with his statement he tried to circumvent the norm of the law on the need to restore the deadline for filing an appeal. The court recognized that the failure to consider this claim was an omission on the part of the court due to the complexity of the case and a large array of claims. The court also rejected the debtors’ petitions to postpone the trial, to return the application for an additional decision, to oblige the Principal to send a copy of the stated requirements to all debtors. The interests of the Principal were represented by Sergey Bibikov, senior lawyer of the Bureau of Lawyers “De jure”.
