The Moscow City Arbitration Court granted the Principal’s claims to recover property from the Defendant’s illegal possession for a total amount of more than 4 million rubles (more than 100 items in total). The requirement to recover a court penalty in case of non-execution of the court decision on the return of property has also been satisfied. The process was complicated by the fact that the property had been in the possession of the Defendant for almost 5 years and it was quite difficult to prove the fact of its safety. At the same time, access to the building where the property was located was limited, which allowed the Defendants to hide some part of it, despite the fact that it was difficult to individualize most of the property. But the lawyers of the Bureau still managed to prove both the fact of illegal possession of property and its safety. One of such evidence was the photo of the Defendant against the background of the disputed property, posted by him on social networks.
