The Moscow Regional Court refused to satisfy the appeal of the procedural opponent of the Bureau of Lawyers “De jure” against the decision to recognize as the inaction of the bailiff in connection with the failure to initiate enforcement proceedings. The lawyers of the Bureau managed to convince the court that the inaction of the bailiff really took place, and the filing of an appeal by the Debtor for enforcement proceedings is aimed solely at delaying the process of fulfilling the requirements of the executive document. The interests of the Principal were represented by Ekaterina Bulygina, Senior Lawyer of the Bureau of Lawyers “De jure”.
The Moscow Regional Court left unchanged the decision on debt collection in favor of our Principal – creditor in the framework of the bankruptcy case. This decision was appealed by another creditor, who used an extraordinary appeal procedure. As part of the dispute, the lawyers of the Bureau managed to defend the decision of the lower court, as well as the status of the creditor of their Principal in the bankruptcy case, the arguments of the appellant about the lack of money, affiliation and dishonesty of the Principal’s behavior were refuted. The interests of the Principal were represented by Rashid Gitinov, Head of practice of the Bureau of Lawyers “De jure”, and Ilsur Zakirov, senior lawyer of the Bureau.
