The Presnensky District Court of the city of Moscow refused the procedural opponents of the Principals to satisfy the requirements for invalidation of auctions for the sale of real estate, in which the Principals were recognized as winners. When making the decision, the court took into account the objections of the lawyers of the Bureau of Lawyers “De jure” that there were no coordinated actions and anti-competitive agreements on the side of the Principals, aimed at preventing (eliminating) other participants from the auction, and by itself, the similarity of the behavior of several entities was not a basis for concluding that there was a competition-limiting agreement between them. It should be noted that this is not the first auction that was contested by the opponents of the Principals, but in none of the disputes did the procedural opponents manage to win over the lawyers of the Bureau of Lawyers “De jure”. These actions of the opponents are due to the fact that the objects are located in the area of the so-called “golden mile” of Moscow and are particularly attractive for the development market. The dispute was considered in the court of first instance for more than a year and a half. The interests of the Principals were represented by Ilsur Zakirov, Senior Lawyer of the Bureau of Lawyers “De jure”.
