The Bogucharsky District Court of the Voronezh Region protected the interests of the Principal and canceled interim measures on the property of his debtor, subject to sale in the framework of the bankruptcy case. Earlier, the debtor’s wife filed a claim for the division of jointly acquired property and asked the court to seize him. Lawyers of the Bureau of Lawyers “De jure” managed to convince the court that the adoption of measures violates the rights of the Principal, since he, as the Defendant’s creditor, expects the immediate sale of property and satisfaction of claims. The court also agreed with the Bureau’s arguments that the spouse’s actions for judicial protection were taken in circumvention of the Bankruptcy Law, which is unacceptable. As a result of the cancellation of interim measures, obstacles to the sale of property were removed and the process of repayment of the Principal’s claims was accelerated. The interests of the Principal were represented by Ksenia Stikhina and Sergey Bibikov, senior lawyers of the Bureau of Lawyers “De jure”.
