The Moscow Arbitration Court fully satisfied the Principal’s claim against the executive authority of a constituent entity of the Russian Federation to resolve disagreements regarding the price of a real estate purchase and sale agreement. The price for purchasing real estate from municipal property was set by the court in the amount of 25 million rubles against the initially established amount of 54 million rubles. During the trial, the Defendant filed unreasonable objections regarding the compliance of the expert’s opinion with the requirements of current legislation and a request to summon him for questioning. At the same time, the Bureau staff managed to convince the court that the expert complied with all mandatory requirements and there was no need to interrogate him, since the inclusion of VAT in the market value of the object does not comply with the provisions of the Tax Code of the Russian Federation. This led to the full satisfaction of the Principal’s claims and a reduction in the redemption price by more than 50%. The interests of the Principal were represented by Khorolets Dan, lawyer of the practice of resolving economic disputes of the Bureau of Lawyers “De jure”.
