The Moscow Arbitration Court approved a settlement agreement on the Principal’s claim, prepared by lawyers of the Bureau of Lawyers “De jure”. The essence of the requirements was to recover damages (in connection with the construction of temporary buildings and structures for the construction of a federal road) from the General Contractor, who suspended work to the Contractor, and then unilaterally changed the previously agreed scope of work. The legal position of the Bureau’s lawyers and the evidence presented in ten volumes (supply agreements, invoices, work contracts, payment documents) were so convincing for the Defendant that before the main court hearing, the opponent recognized the validity of the claim, signed a settlement agreement and fulfilled the obligation to refuse from a bank guarantee for the entire amount of losses, which was offset against the Principal’s repayment of the advance payment under the contract. The Moscow Arbitration Court refused to satisfy the claims against the Principal for the collection of debt in a total amount of more than 50 million rubles under three contract agreements. During the dispute, lawyers of the Bureau of Lawyers “De jure” proved that the Plaintiff had abused his rights, which served as the basis for refusing to satisfy the claims. The Plaintiff previously had admitted the absence of debt, failure to complete work for part of the advance payment, violation of deadlines for completing work under contracts and had signed acts on completion of work. However, two years after the work was completed and almost a year after the facility was put into operation, he appealed to the court with claims for debt collection. The former general director interviewed during the proceedings confirmed the authenticity of the work completion acts. The court recognized this document as authentic and reliable evidence.
