At the third round of consideration of the case, the Moscow Regional Court re-satisfied the claims of the Principal-heir brought against the sister of the deceased brother about the illegal withholding of funds received under a real estate purchase and sale transaction. After the cancellation of the appeal ruling in cassation, the lawyers of the Bureau of Lawyers “De jure” again convinced the court of the correctness of the stated claims, which recovered 2 million rubles in favor of the Principal with interest accumulated over 2 years as unjustified enrichment. It is noteworthy that at the first round of consideration of the case, the Domodedovo City Court refused to satisfy the claim, not considering it necessary to apply the provisions of the law on the contract of assignment to the distribution of the burden of proof on claims for recovery of unjustified enrichment. At the new appeal, the lawyers of the Bureau of Lawyers “De jure” focused the court’s attention on the evidence presented in the case and the explanations of the first cassation made in the case of the heir. The Krasnogorsk City Court satisfied the Principal’s claims for debt collection under the consumer loan agreement and recovered more than 30 million rubles from the debtor. The lawyers of the Bureau managed to prove that the borrower had been violating the terms of the consumer loan agreement with regard to the timing of interest payments by a total duration of more than sixty calendar days during the last one hundred and eighty calendar days. This confirmed the Bank’s right to early repayment of the remaining amount of the consumer loan together with the interest due.
