The Tenth Arbitration Court of Appeal defended the interests of the Principal, leaving unchanged the ruling on challenging the transaction of his debtor. A correctly developed position in the appellate court, as well as evidence previously collected and presented to the court of first instance, allowed the lawyers of the MCBA “Bureau of Lawyers “De jure” to convince the court of the reliability of the conclusions of the appealed ruling on the illegality of transferring funds in favor of the Defendant, registration of real estate in his name. Having proved that the Defendant and the debtor used the concept of an imaginary owner, the Bureau returned to the bankruptcy estate not the right to claim funds, but the apartment. As a result, the Principal will be able to obtain satisfaction of his claims at the expense of liquid property, the value of which is estimated at more than 40 million rubles. The interests of the Principal were represented by Ksenia Stikhina, senior lawyer of the Tyumen branch of the “Bureau of Lawyers “De jure”.

The Kaluga District Court sentenced V. A. Samsonov, the former General Director of the Kaluga Region Development Corporation (the Principal of the Bureau), for accepting a bribe and official forgery. According to investigators, in 2021, the corporation and the contractor signed an agreement on the construction of a railway branch. However, when carrying out the work, the contractor was violating the construction completion deadlines, citing a lack of money, but Samsonov, realizing that some of the work had not been completed, was signing documents confirming their completion. For the first time, the forged documentation was signed by the director of the corporation in order to avoid disciplinary punishment, and for the second time he received a bribe in the amount of 500 thousand rubles for such a service. The accused himself admitted his guilt and on December 14, 2023 the court sentenced him to 3 years in a strict regime colony. Later, the verdict was appealed by Pavel Sorkin, lawyer of the “Bureau of Lawyers “De jure”, as a result of which the Kaluga Regional Court changed Samsonov’s sentence to 4 years of suspended imprisonment and released him from arrest in the courthouse.
