The Tushinsky District Court of Moscow has declared illegal the dismissal of the Principal of the Bureau of Lawyers “De jure” from the position of a top manager of an IT company.
The employer decided to reduce the position of the Principal, motivating this allegedly by organizational and economic necessity. In reality, the owners of the company, having received all the valuable developments of the Principal, simply wanted to get rid of the highly paid specialist and not pay him severance pay. Under the pretext of staff reduction, while formally following the procedure, the employee was fired. However, Alexander Uchaykin, senior lawyer of the practice of resolving economic disputes of the Bureau of Lawyers “De jure”, managed to prove to the court that the staff reduction in the amount of one full-time unit was carried out on far-fetched grounds solely for the purpose of discriminating against the employee. As a result, the court declared the dismissal of the top manager as illegal and reinstated him in his previous position, collecting about 6.5 million rubles for the period of forced absence.
