The fight against a large insurance company has ended in our favor!
In 2022, a fire occurred at the Leroy Merlin facility during working time, when our client was carrying out construction, installation and finishing work there. After that, the client turned to us for legal assistance, and we turned to the Sogaz insurance company for compensation of damage. However, the insurance company refused to pay, referring to a clause in the contract, which, in their opinion, excluded this case from insurance coverage.
In order to challenge Sogaz’s refusal, we had to go to court. During the process, the insurance company tried:
– challenge the examination of the Ministry of Emergencies;
– insisted on conducting a new forensic examination;
– disputed the amount of actual expenses that were required to be compensated.
But thanks to the competent and strict position of our lawyer, the court completely stood on our side:
- Recognized the fire as an insured event;
- Refused to appoint a new examination;
- Recovered 108 million rubles from Sogaz as compensation for damage and 11 million rubles percent for the unlawful retention of funds.
