Our client is an official dealer of a well-known German furniture manufacturer. It owns a corresponding account on the Yandex platform, a virtual showcase where everyone can get acquainted with the exquisite assortment and share their impressions.
As a result of studying the feedback, the client found that several negative reviews in his official account contain false information discrediting his business reputation, as well as misleading consumers of services. In particular, it was pointed out that there were violations of specific contractual obligations that did not actually take place, false information about the payment procedure, and accounts created specifically to post reviews only in relation to the client’s organization were identified. All the controversial publications were a manifestation of unfair competition, with the aim of underestimating the company’s rating.
Considering that the reviews contained false information affecting the business reputation of the branch, the client turned to us for legal assistance.
We have taken into account the explanations of the Supreme Court of the Russian Federation that judicial protection of the honor, dignity and business reputation of a person in respect of whom defamatory information has been disseminated that does not correspond to reality is also not excluded in cases where it is impossible to identify the person who disseminated such information. Evidence was collected to confirm the falsity of the information provided and a statement of protection of business reputation was prepared.
As a result of the consideration of the case in the arbitration court, the client’s position was found to be justified, and the false information contained in the reviews was found to be untrue. Due to this decision, the owner of the platform will have to delete the mentioned reviews.
