The Moscow Arbitration Court refused to satisfy the creditor’s request for indexation of the funds awarded to him in the amount of more than 29 million rubles.
Despite the formal nature of such proceedings, in this case, lawyers of the Bureau of Lawyers “De jure” managed to defend the interests of the Principal and convince the court that the legal indexation mechanism is intended to compensate for the creditor’s inflationary losses, and not to be used for enrichment. Since the court decision taken in the case is accompanied by the accrual of a penalty covering possible inflationary losses of the creditor, the court decided to refuse to satisfy the application, which allowed the Principal to avoid additional financial losses.
